This OLG. ca Player Agreement - Terms of Use contains the terms and conditions governing your use of OLG's online gaming platform, OLG. ca. The following terms shall have the following meanings, and the grammatical deformation of the terms shall have a response.

The "dormant account" means the player account described in Article 10, Paragraph 2, but does not include the player account of the person registered in My GamePause.

"Player account" is an account of a player that has an assumed funding equivalent to the Canadian dollar held in the online gaming system. It means that it contains accessible game information.

"Closed account" means the player account according to paragraph 11. 1.

"Unused Funds" means notional funds equivalent to Canadian dollars deposited into a Player's Account, including winnings, but excluding Bonus Funds, that have not been used by the Player.

"Prospective Player" means any person described in clause 4. 1.

"OACC Standards" means the Registrar's Gaming Standards and Registrar's Gaming Standards applicable to the lottery sector as established and promulgated by the OACC Registrar, as amended or replaced from time to time.

"CAJO Internet Gaming Standards" means the Registrar's Internet Gaming Standards.

"OLG" means the Ontario Lottery and Gaming Corporation and its successors.

"OLG. ca" means the OLG website and mobile application on which selected games are offered to eligible players from time to time.

"Direct Payment" means paying for purchases of lotteries played online using a Player Payment Method online, without using Unspent Funds and/or Bonus Funds and without crediting funds to a Player Account (subject to the System being available).

"Unavailable Period" has the meaning set out in Section 15. 2.

"Excluded Person" means an individual who is not eligible to create an Account with OLG. ca or, if they already have a Player Account, an individual who is not eligible to have an active Player Account:

  1. Anyone who does not meet the eligibility requirements set out in Section 4. 1 hereof;
  2. Anyone who has been excluded from OLG. ca pursuant to a court order, applicable law or regulation, or any rules or policies adopted thereunder, including the OACC Standards;
  3. Anyone who is prohibited from accessing a gaming site or playing lotteries pursuant to Section 3. 01 or 3. 01. 1 of the CAJO Internet Gaming Standards or any other relevant provision of the CAJO Internet Gaming Standards or the CAJO Standards from time to time;
  4. Any person who has self-excluded from the Casino (as that term is defined in the OACC Gaming Standards) under My Play Break during the term of My Play Break (see Responsible Gaming Policy and My Play Break for further information);
  5. Any person who is employed by OLG or who is prohibited from creating an account on OLG. ca by contract or other agreement with OLG;
  6. An individual who is employed by an "online gaming provider" or "online gaming entertainment" (as those terms are defined in the OLG Online Lottery Play Rules, as amended or modified from time to time).
  7. "OLG Online Gaming Privacy and Cookie Policy" means OLG Online Gaming Privacy and Cookie Policy. ca. Subject to Section 3, the OLG Online Gaming Privacy and Cookie Policy is incorporated into and makes a part of this Agreement.

"Responsible Gaming and My Gaming Break Policy" means the OLG Responsible Gaming Policy specific to OLG. ca, as amended or replaced by OLG from time to time. Subject to Section 3, the Responsible Gaming and My Gaming Breaks Policy is incorporated into and forms part of this Agreement.

"Digital Payment Wallet" means an application on a desktop or mobile device, such as a mobile phone, tablet or laptop, that stores payment information to facilitate online or contactless payments. Payment information may be stored in a Digital Wallet, including, but not limited to, credit card numbers, debit card numbers, prepaid card numbers or loyalty card numbers.

"Drawing Rules" means the terms, conditions, descriptions, rules and procedures, including prize structures, published from time to time by OLG or Interprovincial Lottery Corporation (in addition to this Agreement) that apply to any draw conducted online and that are designated by OLG as the Drawing Rules. Subject to Section 3, the Drawing Rules are incorporated into and form part of this Agreement.

"Pay-to-Play Games Terms" means the terms, conditions, instructions, rules and procedures (such as the method of winning prizes, the value and odds of winning prizes in a particular Pay-to-Play Game, and the level of prizes in a particular Pay-to-Play Game) issued by OLG from time to time (in addition to these Terms) that apply to a particular Pay-to-Play Game and that OLG designates as the Pay-to-Play Games Terms. Subject to Section 3, the Pay-to-Play Games Terms are incorporated into and made a part of this Agreement.

  1. "Chargeback" has the meaning set out in Section 6. 4.
  2. "Player Support" means the customer support service at OLG. ca that may be contacted in accordance with Section 18. 1.
  3. "Suspended" or "Suspended" means a Player Account that is in the "Suspended Account" status as described in Section 12. 1.
  4. "Online Gaming System" means the system used by OLG to create and manage Player Accounts, facilitate Player game play and pay out winnings.
  5. "Future Games Transaction" has the meaning set out in Section 5. 3.
  6. "Player Transactions" has the meaning set out in Clause 10. 1.
  7. 3 Other documents that form part of these Terms
  8. These Terms incorporate by reference the terms, conditions, policies, statements and explanations from other documents, including:

the applicable Lottery Rules and Pay-to-Play Rules;

the applicable Website Terms of Use;

the applicable Mobile Application User Agreement;

the Responsible Gaming Policy and My Gaming Break;

Direct Pay Subscription Terms;

the applicable Bonus Fund Terms;

OLG Online Gaming Privacy and Cookie Policy.

In the event of any conflict or inconsistency between the terms of this Agreement and any other terms, conditions, policies, statements or explanations, they shall take precedence in the order set out in i. to vii. above. However, for these purposes, this Agreement shall take precedence after the applicable Lottery Rules and Money Play Rules referred to in clause i. and before the terms, conditions, policies, statements and explanations referred to in clauses ii. to vi.

4 Creating a Player Account

4. 1 Eligibility to Create a Player Account

Only players are eligible to play online lottery draws and paid games through OLG. ca. A person who wishes to become a player ("Prospective Player") must meet the following eligibility requirements as determined by OLG in its sole discretion:

A prospective Player must not already be a Player; A Player may only have one Player Account; Creating or attempting to create multiple "Player Accounts" is a breach of the essential elements of these Terms;

A prospective Player must be 18 years of age or older; Only players 19 years of age or older are eligible to play paid and free games; All players 18 years of age or older are eligible to play online lottery draws;

A prospective Player must be a resident of Ontario;

A prospective Player must be physically present in Ontario at all times when playing games (including when creating an account for future gaming transactions);

A prospective Player must not be an Excluded Person;

A prospective Player must be an individual acting on his or her own behalf. and shall not act for or on behalf of any person other than himself, whether as an agent or not;

When registering, the prospective player must provide true, complete and accurate information;

With respect to online sports betting games, the prospective player must comply with the provisions of clause 14. 5. 5(a), (b), (c) and (d) each time he plays any of those games.

If the prospective player does not meet all of the above criteria, he shall not be eligible to create an account with OLG. ca or to become a Player. OLG may, in its sole discretion, request additional information or documentation from the prospective player or player before or at any time thereafter to complete the creation of the Player Account, for the purposes of verifying the player's identity or contact information, and for the purposes of investigating any other suspected breach of this Agreement, including suspected fraud or misconduct. The failure of the prospective player to comply with any of the above criteria constitutes a breach of the Mandatory Elements of this Agreement.

OLG shall disclose the registration information provided by the prospective player and any additional information or documentation required to verify the registration information provided by the prospective player to third party service providers in order to verify that the prospective player meets the aforementioned conditions and is eligible to create a Player Account. In addition, OLG may disclose Player information to third parties from time to time in order to (i) verify that the player remains eligible to have a Player Account, (ii) investigate suspected violations of these Terms (including suspected fraud or misconduct), and (iii) exercise any other rights set out in these Terms or any other documents incorporated herein by reference.

  1. By providing information or material to OLG, the prospective player (or player, as the case may be) consents to OLG's use and disclosure of such information for the purposes set out in this Agreement or any other documents incorporated herein by reference, subject to clause 3. For more information on OLG's collection, use, disclosure and storage of personal information, please see the OLG Online Gaming Privacy and Cookies Policy.
  2. 4. 2 Player Account Information

The information provided by a prospective player when creating an account on OLG. ca shall be true, accurate and complete at the time it is provided to OLG and shall remain true, accurate and complete after the creation of the Player Account. If the information provided when creating a Player Account changes after the creation of the Player Account, the player shall be responsible for verifying his/her continued eligibility to have a Player Account in accordance with the terms and conditions of this Agreement and, if necessary, updating such information in the Player Account through the "My Account" or "Account Information" pages.
  4. OLG may disclose the registration information of the player to a thir d-party service provider to confirm that the registration information of the player is true and accurate. OLG can always request additional information and materials from the OLG's unique discretion, and OLG can disclose it to a third party for such a purpose.
  5. You shall agree to collect, use, save, and disclose your personal information defined in the OLG Privacy and Cookie Policy by OLG and its thir d-party service providers. You agree that this information will be used, stored, and disclosed in the Ontario and Canada. If the player does not change the player account information in a timely manner, it will be a violation of the important conditions of this agreement.   3. 4. 3 Documentation requirements

OLG may request additional information and documentation from the Player if OLG, in its sole discretion, determines that such information or documentation is necessary to comply with applicable legal and regulatory requirements, or if OLG determines that it is necessary or appropriate to collect certain information or documentation to prevent suspected or actual fraud or other illegal activity, to investigate any suspected or actual violation of any provision of these Terms and Conditions, or to verify the Player's identity or right to obtain or withdraw any unspent funds. Without limiting the generality of the foregoing, the Player shall provide OLG with such information and documentation as OLG deems necessary to comply with its reporting obligations to FINTRAC. By providing additional information and documentation to OLG, the Player shall be deemed to represent and warrant to OLG that such information is true and accurate and that such documentation is a true, accurate and complete copy of the original. 4. 4 Access to Player Accounts

When creating a Player Account, a prospective Player will create credentials. When creating a Player Account, the Player is solely responsible for the security and confidentiality of his/her credentials, including any associated security and identity questions and answers. The Player is prohibited from disclosing the credentials to any other person (including, but not limited to, other Players, potential Players, family members and minors) and only the Player may use the credentials to log into the Player Account. Without limiting the generality of the above, the Player is prohibited from allowing others to access his/her Player Account using credentials or biometric authentication on his/her device for any reason. After the correct credentials have been entered or applied (including when biometric device authentication is enabled), all transactions made through the Player Account (such as changes to account creation information and Player contact information, deposits, withdrawals, games played and lottery tickets purchased, etc.) will be deemed to have been made by the Player, and the Player is solely responsible for such transactions. Players are responsible for the care and management of any device used by the Player to access OLG. ca, store biometric data on the device, or activate biometric device authentication. Players acknowledge that when device biometric authentication is activated through a Player's account, biometric data stored on the device used to activate the feature may be used to access the Player's account. If a Player uses device biometric authentication to access a Player's account, the Player shall be deemed to have represented and warranted to OLG that the Player's own device biometric data, and not that of any other person, was used in connection with device biometric authentication. OLG does not access or store device biometric data.

  1. OLG shall not be liable for any direct or indirect damages arising out of or in connection with a Player's use, inability to use, or activation of device biometric authentication. OLG reserves the right to disable biometric device authentication at any time without notice.
  2. Players have the option to enable multi-factor authentication, in addition to using the Player's credentials, as an additional verification factor to access the Player's account. "Multi-Factor Authentication" means an authentication method that requires a player to enter a time-based one-time password provided by a third-party application in addition to the player's credentials to verify the player's identity when attempting to log into the player's account. "Time-Based One-Time Password" means a temporary password generated by a third-party application that can only be used once within a certain period of time, after which the player must enter a newly generated time-based one-time password.
